Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the Pulse music library applications for Android, iOS, and related web experiences (the “App”), operated by Universally Thinking (Swagger Group, LLC) (“we,” “us,” or “our”).

By downloading, installing, or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.

App Store note: If you obtained Pulse from Apple’s App Store or Google Play, those storefronts’ standard terms also apply to the distribution of the App. In a conflict about purchase, refunds, or store billing, the applicable store’s terms control those topics.

1. Eligibility

You must be at least 13 years old. If you are under 18, you may use the App only with a parent or guardian’s permission. You are responsible for activity under your account and device.

2. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, for personal or internal use, subject to these Terms. You may not reverse engineer, redistribute, rent, or create derivative works of the App except as allowed by law.

3. Your content and media

You retain rights in audio files, artwork, playlists, and metadata you add (“Your Content”). You represent that you have the rights needed to store, play, edit, and export Your Content in the App. Local edits and exports stay under your control on your device unless you sync or share them.

Do not use Pulse to infringe copyrights or violate streaming-service rules. You are solely responsible for ensuring your use of local files and connected catalogs is lawful.

4. Third-party services

Pulse may integrate with Spotify, Apple Music, YouTube, and other providers. Those services are governed by their own terms and privacy policies. We are not responsible for outages, catalog changes, account bans, or DRM restrictions imposed by third parties. Features that depend on a third party may change or stop without notice.

5. Song requests

Host and guest request features are provided as-is. You are responsible for how you share join codes and for content requested in your sessions. We may limit, suspend, or discontinue request features to protect users or our systems.

6. Accounts

Optional accounts may enable library sync. Keep credentials confidential. We may suspend or terminate accounts that abuse the service, violate these Terms, or create security risk.

7. In-app purchases and subscriptions

If the App offers paid unlocks or subscriptions through Apple or Google, billing, renewals, cancellations, and refunds are handled by the applicable store under its policies. Manage or cancel subscriptions in your Apple ID or Google Play account settings.

8. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation, or that exports, edits, or sync will always succeed.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNIVERSALLY THINKING AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $50.

10. Indemnity

You agree to indemnify and hold harmless Universally Thinking from claims arising out of Your Content, your use of streaming services, your request sessions, or your violation of these Terms or applicable law.

11. Termination

You may stop using the App at any time by uninstalling it. We may stop providing the App or revoke access if you breach these Terms. Sections that by nature should survive (including disclaimers, liability limits, and indemnity) will survive termination.

12. Changes

We may update these Terms. The effective date will change when we do. Continued use after an update means you accept the revised Terms. If you do not agree, stop using the App.

13. Governing law

These Terms are governed by the laws of the State of Ohio, USA, without regard to conflict-of-law rules, except where mandatory consumer protections in your country apply. Courts in Ohio have exclusive jurisdiction, subject to those protections.
